View of the Social Workers of the Department of Social and Legal Protection of Children of Central Bohemian Region on the Issue of Placing a Child in Institutional Care

The bachelor work is concerned with the placement of a child in institutional care. The theoretical part decribs the concept of dilemma, division dilemmas, manging dilemmas, dilemma intervence-not intervence and the related decisions, measures child protection and the possibility of solving social workers, within the family and in the case, where a child is at risk. The practical part of the qualitative research in the form of semi- structures interview answers the main research question which is: What procedures apply social workers awithin the dilemma intervence-not intervence? Families at risk of social failure in the region of Karlovy Vary

This thesis is focusing on families at risk of social failure in the Region of Karlovy Vary. The aims of this work are outlining social situation in the Region of Karlovy Vary, mapping network of social service for families at risk of social failure and finding out the most frequent problems these families are struggle with. Outputs are the recommendations for SOS Children's Villages in Doubí in Karlovy Vary based on above presented findings that tells which services for families at risk would be advisable to set up. In theoretical part of final thesis is defined the concept of family at risk and then based on foreign experiences are cited the principles of how to work with these families. Practical part is build on study of feasibility realizes by SOS Children's Villages Association, which was finding out neediness of social services for families at risk and children in the Region of Karlovy Vary, where this organization is considering realization of programs for family support.
Shared custody in the district of Prague 14

This bachelor thesis deals with shared custody as a post-divorce form of parenting. It discloses the most important legislation governing shared custody as well as the child's interest and the relationships between parents and children. The theoretical part provides the legal definition of divorce and shared custody. It examines the factors that influence the court's decision on shared custody and provides information on the development of the findings made by the Constitutional Court regarding shared custody. The influence of shared custody on the child's school success in primary school

The topic of this diploma thesis is the influence of joint custody on school successfulness of a child. In the theoretical part I describe a contemporary family and major functions of the family. I chart the situation of legislation in the Czech Republic, I deal with circumstances how the Czech courts make a decision about commiting children into parental care after a divorce of their parents and whether the number of children being involved in joint custody increases. I am really interested in the fact whether the courts make a decision based on the child needs. Following this part I focus on the definition of school successfulness of children and the behaviour of younger learners. I indicate the factors that could have an influence on school successfulness. In the practical part I present the results of my qualitative research. I explore the influence of joint custody into child school successfulness from the point of view of class teachers. I survey the behaviour of children who live in joint custody after the divorce of parents and I also take an interest into the fact whether the class teacher have noticed any features that could connect these children.
The relationship of parents to minors with regard to the specifics of domestic violence

The dissertation thesis "Relationship of parents to minors with regard to the specifics of domestic violence" focuses in particular on judicial proceedings in cases of custody of minors where family relationships are affected by domestic violence. It attempts to explain why it is necessary for the courts to take into account this fact and to adopt such measures within their decisions to provide sufficient protection to persons at risk and at the same time to stop violent behaviour. Domestic violence as a dangerous social phenomenon is described in detail; information on its individual appearances and forms is brought; briefly mentioned are also other scientific disciplines whose knowledge is important not only for the recourse of offenders and the protection of victims but also for creation of a strategy of effective prevention. Negative impacts on mental state of minors are stressed, who must be viewed in all cases of domestic violence as its victims, i.e. also when the violent behaviour is not immediately directed against them. The thesis brings interpretation of the current legislation with reference to the most important changes in the legislation in the last decade. Abstract, key words Title of the thesis: Shared residence in Czech and German law The aim of this thesis is to compare the approach to shared residence in the legal order of the Czech Republic and the Federal Republic of Germany, i.e. to find out to what extent the approaches of these countries to shared residence differ. This is examined in relation to selected issues which courts had to deal with when deciding on the shared residence, i.e. the influence of the child's wishes, the parents' will, their ability to communicate and long distance between the parents' households on the suitability of shared residence. Special attention is paid to the presumption of shared residence, or shared residence as a rule. The thesis focuses on the effective regulations. The thesis is divided into three parts. The first part deals with the Czech regulation of the shared residence. The individual chapters explain basic terminology, sources of law, legal regulation of shared residence, case law on the selected issues, including the presumption of shared residence, and some of the specifics of maintenance obligation. Interest of the child and divorce of parents in the Czech and Norwegian Law Abstract The aim of this rigorosum thesis is to describe, analyze and compare current legislation of divorce of marriage in families with under-aged children, parental responsibility after divorce, and individual post-divorce living arrangements in the Czech Republic and Norway. The thesis defines the best interest of the child and evaluates how it is perceived, met and protected during the divorce in the Czech and Norwegian legislation. It further covers the role and competence of the child protective services in both countries. The thesis is divided into seven sections. The first section is dedicated to the concept of legislation of divorce in families with children and their protection. The second section covers the key terminology of the thesis - the best interest of the child and child welfare. The third, main section of the thesis describes and analyzes individual criteria, which are decisive for the regulation of the circumstances of a child during the divorce of marriage. The exercise of parental responsibility by persons serving prison sentence

The Diploma Thesis called The exercise of parental responsibility by persons serving prison sentence deals with the institute of parental responsibility, which means fulfilling and execution of rights and duties of parents serving prison sentence towards their underage children. Legal framework of this institute pursuant to current legislation in the Civil Code is described in detail in the theoretic part, the next part deals with the execution of sentence prison sentence as a specific life circumstance in which a human being is caught in as a parent. The research survey carried out in selected Czech penitentiaries for execution of prison sentence of men and women. The thesis analyses the current legislation of rights and duties of parents serving prison sentence and maps their carrying out in practice. Using the quantitative methodology, the results of the research survey show that rights and duties of parents acknowledged by legislation and in practice of the Constitutional court of the Czech Republic are substantially restricted during the execution of prison sentence. This Diploma Thesis is focused on the issue of the value of a child's wish in the framework of the divorce/break-up settlement. In the theoretical part of this thesis, the child's status, its right to participate and the means of ensuring that in the mentioned framework are presented. In this thesis, the term child's wish is also discussed in the context of defending child's own interest. In the last chapter of the theoretical part, there is illustrated the suitable way how to interview a child. The aim of the practical part is to, through half-structured interviews with the professionals taking part in this process and an analysis of those interviews, answer the main research question: How do the professionals taking part in the divorce/break-up settlement perceive and deal with the child's wish in this process? The research part of this thesis is also focused on the possible space for change in the contemporary attitude towards children as participants of trials.

Legal status of a child after break-up of their parents Abstract The goal of this thesis is to thoroughly elaborate about possible arrangements of situation of a child after the break-up of their parents, with focus on specifics of joint custody. The aim is also to critically evaluate corresponding practices of the Czech Constitutional Court and to put current legal regulations into historical and comparative context. The topic of this diploma thesis is legal status of a child after break-up of their parents. It is focused both on children of married and unmarried parents. An extra chapter about legal status of children from atypical families is also included, which addresses unusual legal positions of children of same-sex parents, children born via surrogacy and children raised by foster and adoptive parents. In the first chapter the marriage, cohabitation and differences between these two is discussed. A brief description of how the law in question evolved is included as well.
